NCERT Legal Education Curriculum – Supreme Court Intervention & Formation of Expert Committee

Introduction

Education is an important tool for creating social awareness. In particular, Legal Education helps students understand the Constitution, Judiciary, and Citizens' Rights. In this context, the controversy in the NCERT textbook led to a significant development where the Supreme Court intervened and ordered the formation of an expert committee.

Background of the Controversy

In the Class 8 Social Science textbook, a section titled “Corruption in the Judiciary” was included. It highlighted issues such as:
Pendency of cases
Shortage of judges
These were mentioned as challenges.
This led to controversy as it was perceived to affect the credibility of the judiciary.

Supreme Court Intervention (Judicial Review – Article 32)

The Supreme Court took suo motu cognizance of the issue:
Ordered withdrawal of the textbook
Took steps to ensure quality and balance in educational content
This is an example of the Court’s power of Judicial Review under Article 32.

Formation of Expert Committee

Based on the Supreme Court’s direction:
Former judges
Legal experts
Educationists
were included in forming an expert committee.
➤ This is a clear example of the constitutional principle of “Checks and Balances”.

Right to Criticize Judiciary

The Supreme Court clarified:
Criticism of judgments is a Fundamental Right under Article 19(1)(a)
• However, it must be “Constructive Criticism”
Thus, it emphasized that criticism should be responsible.

Educational and Political Neutrality

Textbooks should avoid political or one-sided views.
NCERT (National Council of Educational Research and Training) is responsible for maintaining educational standards.
Hence, balanced and factual information must be provided.

Challenges in Judiciary

This issue also highlights the ongoing challenges in the judiciary:
Over 3 crore pending cases
Low Judge-Population Ratio
Need for judicial reforms

Conclusion / Way Forward

This incident emphasizes the responsibility in educational content. Legal education must provide students with accurate, balanced, and constitutionally aligned content. At the same time, healthy criticism of the judiciary is essential for the growth of democracy.
